These Terms and Conditions apply to all teaching services provided by Amy Lang as a self-employed language teacher.
Free Initial Consultation: Before starting a collaboration, I offer a free initial video consultation (approx. 30 minutes) on request. In this conversation we get to know each other, discuss your goals and clarify whether we are a good fit.
Trial Lessons: Trial lessons are regular teaching units and are charged at the full price of 44 Euro. There are no free trial lessons.
Payment is made as a monthly flat fee, which remains the same regardless of the actual number of teaching days in the respective calendar month. The flat fee is calculated on the basis of four teaching weeks per month.
Example: For 200 minutes of weekly tuition, the monthly flat fee is 350 Euro. This amount applies to every calendar month regardless of its length.
If a calendar month has more than four teaching weeks (e.g. five agreed lesson dates), the teacher provides these additional teaching units at no extra cost as a voluntary bonus service. This only applies if the lessons take place regularly and without extraordinary events.
The teacher's scope of service is generally limited to four teaching weeks (28 days) per month. In the event of extraordinary circumstances affecting regular teaching, the monthly flat fee is reduced proportionally. Extraordinary circumstances include in particular:
Rescheduling is generally only possible for regular lessons that are part of the agreed schedule. The following conditions apply:
Rescheduling Regular Lessons: Rescheduling is only possible if cancellation occurs at least 24 hours before the agreed appointment. Later cancellations cannot be made up and the lesson is forfeited without compensation.
Bonus Lessons (5th Week of the Month): The bonus service in months with five teaching weeks applies exclusively to lessons attended regularly according to the schedule. If a bonus lesson (the 5th lesson of the month) is cancelled by the student or parents, it is forfeited without compensation – regardless of the notice period given. Making up bonus lessons is generally excluded.
Regular Lessons That Cannot Be Made Up: If regular lesson dates cannot be rescheduled within 14 days for scheduling reasons (regardless of which side cannot find a replacement date), the monthly flat fee is reduced according to the daily calculation set out in § 3a.
Calculation Method:
The reduction is calculated on a daily basis based on the four agreed teaching weeks (28 days). The monthly flat fee is divided by 20 teaching days (4 weeks × 5 weekdays). The resulting daily amount is multiplied by the number of missing teaching days and deducted from the monthly flat fee.
Important: Only the days that are missing to reach the four agreed weeks are deducted.
Starting Situation:
• Monthly flat fee: 350 Euro
• Weekly tuition scope: 5 hours (spread over 5 weekdays)
• Daily amount: 350 Euro ÷ 20 days = 17.50 Euro
Example: One Week of School Holidays
• Remaining lessons: 3 weeks and 3 days = 18 teaching days
• Missing days up to the agreed 4 weeks: 20 − 18 = 2 days
• Deduction: 2 days × 17.50 Euro = 35 Euro
• Amount payable: 350 Euro − 35 Euro = 315 Euro
Guaranteed Minimum Number of Lessons: Should the number of lessons be reduced to fewer than four teaching units in a month due to several public holidays or other extraordinary events (particularly for students with one weekly session), an alternative date within the relevant month will be sought together to ensure the minimum of four units per month.
Cancellations by Student/Parents: If a lesson is cancelled by the student or parents at least 24 hours before the lesson, it can be rescheduled subject to availability. In the event of a later cancellation or non-attendance, the lesson is forfeited without compensation.
Cancellations Due to Illness: In the case of illness-related cancellation, the lesson can be rescheduled where possible. A medical certificate is not required.
Lessons Already Paid For: Lessons already paid for are generally not refunded. The teacher's obligation consists of offering and being available for the booked appointments. If the teacher has to cancel an appointment or is unable to attend, it will of course be rescheduled or refunded.
Rescheduled Appointments: If rescheduled lessons cannot be made up within 14 days, this is considered an extraordinary event within the meaning of § 3a. The monthly flat fee is reduced according to the daily calculation.
The collaboration can be terminated by either party at the end of the month. Notice must be given at least one week before the end of the month. This notice period allows the teacher to fill the freed-up teaching time otherwise.
Important: Termination always takes effect at the end of the month. If notice is given less than one week before the end of the month, it only takes effect at the end of the following month.
Example: Notice given on March 23 takes effect on March 31 (one week's notice is given). Notice given on March 26 takes effect on April 30 (a full week's notice for March is no longer given).
The monthly flat fee is payable until the end of the contract. If notice is given during an ongoing month, the full monthly flat fee is due for that month. If notice is submitted so late that it only takes effect the following month, the full flat fee is also payable for the following month.
Starting Situation:
• Monthly flat fee: 200 Euro
Case 1: Notice given on March 20 → effective March 31
• Payable: 200 Euro for March (full month)
Case 2: Notice given on March 27 → effective April 30
• Payable: 200 Euro for March + 200 Euro for April = 400 Euro
Principle: Amounts already paid are not refunded under any circumstances. This applies regardless of which party gives notice.
Lessons already paid for can be used by the student or parents until the end of the contract. If this right is not exercised, the lessons already paid for are forfeited without compensation. No refund will be issued.
In the event of extraordinary termination by the teacher (e.g. due to repeated misconduct, non-compliance with agreements, non-payment or repeated short-notice cancellations), the contract ends without notice. Lessons already paid for can be used up to the time of termination. No refund will be issued.
In the event of extraordinary termination by the student or parents, amounts already paid are likewise not refunded. Lessons already paid for can be used up to the time of termination.
All teaching materials, worksheets, exercises and other course materials created by the teacher are subject to copyright and remain the teacher's intellectual property.
Usage Rights: Students and/or parents receive a non-transferable, personal right of use for the materials provided, exclusively for the purpose of their own learning. Sharing, reproducing, publishing or commercially using the materials is prohibited without the teacher's express written consent.
Use of Student Work: The teacher may use anonymized student work and learning progress for documentation and promotional purposes. Names are only mentioned with the express consent of the students and/or parents.
Homework and independent preparation and follow-up work are an essential part of learning success and are expected of the student.
The teacher is not liable for learning success, as this depends on the student's participation, commitment and individual circumstances.
Limitation of Liability: The teacher's liability for slightly negligent breaches of non-material contractual obligations is excluded. In cases of gross negligence or intent, the teacher is liable in accordance with statutory provisions.
Excluded from any limitation of liability are damages arising from injury to life, body or health, as well as claims under product liability law.
The teacher undertakes to treat all personal data of students and/or parents confidentially and to use it exclusively for the purpose of fulfilling the contract. Data will not be shared with third parties.
Personal data is processed on the basis of Art. 6 (1) (b) GDPR (performance of a contract). Only data required for conducting lessons and billing is stored (name, contact details, lesson times, payment information).
Data is stored after the end of the collaboration for the duration of the statutory retention periods (in particular tax-related retention obligations) and is then deleted.
Respectful Conduct: The teacher expects respectful, courteous conduct from all students and parents. In the event of repeated misconduct, offensive or disrespectful behavior, the teacher reserves the right to terminate the collaboration with immediate effect.
Late Payment: The monthly flat fee must be paid by the 5th of the month at the latest. In the event of late payment, lessons will be suspended with immediate effect. From the 6th of the month, a reminder fee of 15 Euro applies. If payment is not made by the 12th of the month, the collaboration ends automatically and without notice. Amounts already due remain payable.
Repeated Cancellations: In the event of more than three short-notice cancellations (under 24 hours) within two months, the teacher reserves the right to end the collaboration or adjust the terms.
Austrian law applies to all disputes arising from this contractual relationship. The place of jurisdiction is Graz, insofar as legally permissible.
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
